Registration of collective marks that are used to distinguish the goods or services of members of organizations belonging to a specific entity with legal personality

The application for registration of the collective mark shall be accompanied by the following requirements:

1- Indicate in the registration application that it is a collective mark. 2- A true copy of the statute of the union, organization or public institution requesting registration with the amendments that may have been made to it, provided that it includes the following:

A - A statement of the category of persons entitled to use the mark and their relationship to the applicant. B - A copy of the conditions for using the collective mark for goods and services. C - An acknowledgment that the applicant is or will conduct a close control over the use of the collective mark by its members. D- How the members qualify for membership in that body.

3- All documents should be duly authenticated and certified and translated into Arabic.

Requirements

1- Go to the authority’s website, select the services, and click on the trademarks service.

2- Login to the Trademarks Portal.

3- Accessing the service platform through the unified national access / e-mail.

4- Request to register a new mark (as an owner, stakeholder, or owner of an institution or company).

5- Fill out the data and attach the documents required to register a collective mark.

6- An invoice is issued to study the mark, and if it is paid, the application will be received and studied.

After the study, one of the following decisions is made:

Acceptance of the amendment condition (the deadline for amendment is 90 days). In the event that the applicant does not make the required amendment within 90 days, the application will turn into a waiver.

- Rejection with the possibility of amendment (the deadline for amendment is 10 days). Final refusal in one of the two cases:

- If the amendment is not made within the 10-day period.

- If the modification was made by the customer and he did not fulfill the required statutory conditions.

7- If the application is accepted, the registration applicant or his agent must pay the publication fees within (30 days) from the date of the issuance of the publication invoice in the electronic system, otherwise the application shall be considered forfeited.

8- After paying the fees due by the applicant, the mark (for a period of 60 days) is published in the intellectual property newspaper.

9- After the publication phase ends without any objection submitted, the applicant must pay the final invoice within 30 days of its issuance and then print the certificate through the system.
